Agreement to Terms

By accessing or using Plonkus ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not use the Service.

These terms constitute a legally binding agreement between you and Montis UX AB ("we," "us," "our").

Who Can Use Plonkus

Age Requirement: You must be at least 16 years old to use Plonkus. By using the Service, you represent and warrant that you meet this age requirement.

Account Capacity: You must have the legal capacity to enter into a binding contract. If you're using Plonkus on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Your Account

Creating an Account

• You create an account by signing in with your Google account
• You must provide accurate and complete information
• You're responsible for maintaining the security of your account
• You're responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access at support@plonkus.fun

Account Security

• Keep your Google account secure (we rely on Google's authentication)
• Don't share your account credentials
• Don't let others access your account
• We're not liable for losses from unauthorized account access

Account Termination

By You:

• You can delete your account anytime from your account settings, or by emailing support@plonkus.fun
• Deletion is immediate and cannot be undone. There is no recovery period
• After deletion, your boards, share links, and uploaded images are permanently removed. Encrypted backups may keep a copy for up to 30 days

By Us:

• We can suspend or terminate accounts that violate these terms
• We can terminate accounts for prolonged inactivity (12+ months)
• We'll notify you before termination unless legally prohibited
• Upon termination, your right to use the Service stops immediately

Acceptable Use

You agree to use Plonkus in accordance with these terms and all applicable laws.

You Agree NOT To:

Illegal Activities:

• Violate any local, national, or international laws
• Infringe intellectual property rights of others
• Engage in fraudulent or deceptive practices

Harmful Content:

• Upload content that is illegal, harmful, threatening, abusive, or hateful
• Create boards with offensive, discriminatory, or explicit content
• Share content that promotes violence or harm
• Upload malware, viruses, or malicious code

Service Abuse:

• Spam, harass, or harm other users
• Attempt to hack, reverse engineer, or compromise the Service
• Use automated tools (bots, scrapers) without written permission
• Overload our servers or interfere with Service operations
• Bypass rate limits or security measures
• Use uploaded images outside of Plonkus boards, such as linking to them from other sites or apps

Misrepresentation:

• Impersonate others or falsely represent affiliation
• Create multiple accounts to circumvent restrictions
• Provide false information during account creation

Intellectual Property Violations:

• Don't copy copyrighted questions without permission
• Don't use others' trademarks in your boards
• Respect third-party intellectual property rights

Violation of these rules may result in account suspension or termination.

User Content

Your Content

What You Own:

• You retain all ownership rights to the game boards and content you create
• You're solely responsible for the content you create and share

License You Grant Us:

• You grant us a license to store, display, and distribute your content solely to provide the Service
• This license ends when you delete your content or account
• We need this license to show your boards to other players, enable sharing, and provide cloud storage

Your Responsibilities:

• Ensure you have rights to any content you upload
• Don't upload copyrighted material without permission
• Be respectful and appropriate in your content
• Follow intellectual property laws

Our Rights:

• We can remove content that violates these terms
• We can remove content if required by law
• We're not obligated to monitor user content but reserve the right to do so
• We're not responsible for user-generated content

Content Standards

Your boards and content must not:

• Violate laws or regulations
• Infringe intellectual property rights
• Contain harmful, offensive, or inappropriate material
• Promote illegal activities
• Contain personal information of others without consent

The Plonkus Service

What We Provide

Plonkus is a platform that allows you to:

• Create custom Jeopardy-style trivia game boards
• Host multiplayer game nights with buzzer functionality
• Save boards to the cloud and access them anywhere
• Share boards with others

Service Availability

"As Is" Basis:

• The Service is provided "as is" and "as available"
• We don't guarantee uninterrupted, error-free, or secure service
• We're not responsible for technical issues, downtime, or data loss
• Features may change, be removed, or added at our discretion

No Warranties: We make no warranties, express or implied, including:

• Merchantability or fitness for a particular purpose
• Accuracy or reliability of content
• Security of data transmission
• Availability or functionality

Service Changes

We Reserve the Right To:

• Modify, suspend, or discontinue features with reasonable notice
• Change pricing with 30 days advance notice
• Update the Service to fix bugs or add features
• Temporarily suspend Service for maintenance

We'll Notify You:

• Of significant changes via email or website notice
• At least 30 days before material changes to paid features
• Your continued use after changes means you accept them

If You Disagree:

• You can cancel your account before changes take effect
• No refunds for changes you don't like (see Refund Policy)

Free and Premium Tiers

Free Tier

Free Plonkus accounts include:

• Up to 3 saved boards
• Unlimited classic-mode games
• Buzzer mode with up to 3 players per game
• Text-only clues (media embeds are a Plus feature)
• Board sharing via link
• All Jeopardy mechanics: rounds, Daily Doubles, Final Jeopardy, scoring
• Limited in-app AI clue generation (a free lifetime allowance; Plus removes the cap)

Plonkus Plus

Plonkus Plus is our paid subscription tier. Plus includes:

• Unlimited saved boards
• Unlimited buzzer players per game
• Media in clues, like images and videos, including image uploads
• In-app AI generation (clues, categories, and Final Jeopardy) with generous monthly limits

Subscription Terms:

• Monthly plan: $7 per month, billed monthly
• Annual plan: $49 per year, billed annually
• Billed automatically until you cancel
• Access to Plus features while subscription is active

Image Uploads

Plus lets you upload images to use in your clues. A few rules keep this fair and affordable to run:

• Uploads are for images shown in your Plonkus boards. Don't use them as general file or image hosting for other sites or apps
• Uploads have limits on file size, file type, and total storage per account. The editor tells you when you're close to your limit
• We may adjust these limits to keep the Service reliable and fairly priced. We won't delete images you've already uploaded just because a limit changed
• If an account's images cause unusually heavy traffic or storage use, we may limit or disable access to those images, or pause uploading for that account. We'll contact you first unless the Service is at risk
• Questions about your limits? Email support@plonkus.fun
• We may remove any uploaded image that breaks these Terms, without notice
• Uploaded images can be viewed and saved by anyone you share the board with, and by anyone who has a link to the board or to the image itself. Sharing a board shares its images
• To report a board or an image, use "Report this board" or email support@plonkus.fun
• If you own the rights to something uploaded here and want it removed, email support@plonkus.fun with a link to the board and a short note on what's yours. We'll take it down promptly
• Accounts that repeatedly upload material they don't have the rights to can lose the ability to upload

After Cancellation

If you cancel Plus:

• You keep all boards you've created (we don't delete your work)
• You can still play existing boards (you don't lose access to your games)
• Free tier limits resume at the end of your paid period (3-board cap, 3-player buzzer cap, no adding media to clues, and AI generation limited to the free-tier allowance)
• Images you uploaded stay in your boards and keep playing. Uploading new ones needs Plus
• Your boards remain in your account and can be accessed anytime
• If you resubscribe, you immediately regain all Plus features

This means your investment in creating boards is never lost, even if you cancel.

Payment Terms (Applicable When You Subscribe to Plus)

Pricing

• Plus monthly: $7 per month (USD)
• Plus annual: $49 per year (USD)
• Prices displayed in USD; applicable VAT or sales tax is added at checkout based on your location
• Prices subject to change with at least 30 days notice

Billing & Merchant of Record

• Merchant of Record: Plonkus Plus subscriptions are sold through Lemon Squeezy, who acts as the merchant of record. Your invoice and credit card statement will reference Lemon Squeezy. Lemon Squeezy handles VAT, sales tax, and regulatory compliance globally on our behalf.
• Payment processor: Lemon Squeezy uses Stripe and other processors to handle card transactions. Card details never reach Plonkus.
• Billing cycle: Monthly or annual from your subscription start date
• Automatic renewal: Your subscription renews automatically at the end of each billing period until you cancel
• Failed payments: Lemon Squeezy will retry failed payments. If retries fail, your subscription will be paused or canceled and Plus access will end.
• Taxes: Prices exclude applicable taxes (VAT, sales tax, etc.); Lemon Squeezy collects and remits these as required.

Cancellation

• You can cancel anytime from your Plonkus account settings (which links to the Lemon Squeezy customer portal) or by emailing support@plonkus.fun
• Cancellation takes effect at the end of your current billing period
• No automatic refunds for the remainder of your billing period
• Keep access to Plus features until the end of the paid period
• After cancellation, revert to free tier limits

Refund Policy

Standard Policy:

• No refunds for partial billing periods
• Cancellation stops future charges but doesn't refund the current period
• You keep access until the end of your paid period

Exceptional Circumstances:

• If you experience significant service issues or bugs, contact us at support@plonkus.fun
• We review refund requests on a case-by-case basis
• We may offer refunds for severe service problems
• Good faith matters. If you're genuinely unhappy, we'll try to help

EU Consumer Rights · 14-day Cooling-off Period:

• EU and EEA customers have a statutory 14-day right of withdrawal under EU distance selling rules
• For digital subscriptions, this right ends once the service has begun with your express consent. At checkout, you will be asked to consent to immediate access; doing so waives your 14-day withdrawal right with respect to performance already rendered
• If you have not consented to immediate access, contact support@plonkus.fun within 14 days of your purchase to request a withdrawal

Price Changes

• We'll notify you 30 days before any price increase
• New price applies at your next renewal
• You can cancel before the increase takes effect
• Continuing your subscription after notification means you accept the new price

Intellectual Property

Our Rights

Plonkus Owns:

• The Plonkus name, logo, and brand
• The website design and software code
• All Service functionality and features
• Documentation and marketing materials

You Cannot:

• Use our trademarks or branding without permission
• Copy, modify, or reverse engineer our software
• Remove copyright or proprietary notices
• Create derivative works of our Service

Your Rights

You Own:

• All game boards and content you create
• Questions and answers you write
• Categories and game structures you design

We Don't Claim:

• Ownership of your content
• Rights to use your content outside of providing the Service
• Ability to sell or license your content to others

Exception:

• If you make a board public, other users can view and clone it
• Cloning creates their own copy (doesn't affect your original)

Limitation of Liability

To the maximum extent permitted by law:

We Are Not Liable For:

Indirect Damages:

• Lost profits, revenue, or business opportunities
• Loss of data or content
• Loss of goodwill or reputation
• Any indirect, incidental, or consequential damages

Service Issues:

• Service interruptions or downtime
• Data loss or corruption
• Security breaches (despite our best efforts)
• Third-party actions or service failures

User Actions:

• Content created by other users
• Disputes between users
• Misuse of the Service by others

Maximum Liability

Our total liability to you for any claims related to the Service is limited to:

• The amount you paid us in the 12 months before the claim, OR
• €100 (whichever is greater)

Exceptions

These limitations don't apply to:

• Liability that cannot be excluded under Swedish law
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Your statutory consumer rights under Swedish/EU law

Indemnification

You agree to defend, indemnify, and hold harmless Montis UX AB, its officers, directors, and employees from claims, damages, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these terms
• Your violation of others' rights
• Content you create or upload
• Your breach of intellectual property laws

This doesn't affect your consumer rights under Swedish law.

Dispute Resolution

Governing Law

These terms are governed by the laws of Sweden, without regard to conflict of law principles.

Jurisdiction

Any disputes arising from these terms or your use of the Service will be resolved in the courts of Sweden.

For Swedish Users:

• Disputes can be brought in Swedish district courts
• You may also contact Allmänna Reklamationsnämnden (ARN) for consumer dispute resolution

For EU Users:

• EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr
• You have the right to bring disputes in your own country under certain circumstances

Informal Resolution First

Before filing any legal claim:

• Contact us at support@plonkus.fun to resolve the issue
• We'll work with you in good faith to find a solution
• Most issues can be resolved through direct communication

This doesn't prevent you from seeking legal remedies if informal resolution fails.

General Terms

Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Montis UX AB regarding your use of Plonkus.

Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.

No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right.

Assignment

• You cannot transfer these terms to anyone else
• We can assign our rights and obligations to others (e.g., if we're acquired)

Force Majeure

We're not liable for delays or failures caused by circumstances beyond our reasonable control, including:

• Natural disasters, wars, or pandemics
• Government actions or regulations
• Internet infrastructure failures
• Third-party service outages

We may update these Terms of Service from time to time.

When We Make Changes:

• We'll update the "Last updated" date at the top
• For material changes, we'll notify you via email
• We may also display a notice on the website

Your Options:

• Review changes before they take effect
• If you disagree, cancel your account before changes apply
• Continued use after changes means you accept the updated terms

Acknowledgment

By using Plonkus, you acknowledge that:

• You've read and understood these Terms of Service
• You've read and understood our Privacy Policy
• You agree to be bound by both documents
• You're at least 16 years old
• You'll comply with all applicable laws
